Cynthia Davis and Sam Pratt's law.  Someone please tell me this isn't really happening? How can this woman really be in public office? The things she said are absolutely cold and callous.&lt;br /&gt;&lt;br /&gt;Please help me prove her wrong when she says, "There is nobody in St. Charles County who cares about this bill." She goes on to say, "This woman is not even the mother of the child," Davis said. "She is a law student. What is really going on is that she is mad at the judge and she is mad at the baby sitter.&lt;br /&gt;&lt;br /&gt;They want a souvenir bill for the baby and they wanted it named after the baby. It is the leading cause of death in babies from one month to one year of age.  &lt;br /&gt;• The risk of SIDS is two to three times greater in African American and Native American infants.  &lt;br /&gt;• Steps to reduce the risk of SIDS include the “ABC’s” of safe sleep for babies; babies sleep safest alone, on their backs, in their cribs.  Also, creating a smoke-free zone around babies can help lower the risk.&lt;br /&gt;&lt;br /&gt;Founded in 1974, SIDS Resources Inc. is the only Missouri nonprofit that provides emotional support for families who have lost babies to Sudden Infant Death, and also educates the community about safe sleep for babies and other risk reduction strategies. Storch Files “Nathan’s Law” Legislation in MO House to Tighten Child Care Regulations &lt;br /&gt;&lt;br /&gt;Bill would protect children across Missouri by addressing weaknesses in state laws and regulations that govern child care facilities.&lt;br /&gt; &lt;br /&gt;JEFFERSON CITY – Representative Rachel Storch (D-St. Louis) filed legislation today that would strengthen and tighten the laws that govern Missouri child care facilities.&lt;br /&gt; &lt;br /&gt;“Last year, I learned of the tragic death of Nathan Blecha, an infant who had died in a Missouri child care facility,” said Storch.  “The circumstances of his death led me to look into Missouri child care laws and regulations.  I discovered that, despite two audits conducted respectively by former Auditor Claire McCaskill and current auditor Susan Montee that point out weaknesses in Missouri laws and regulations, the General Assembly has failed to act and as a result, Missouri law does not adequately protect our children.  The legislation I am filing today will strengthen the state laws that govern child care facilities and help ensure the safety of our children.”&lt;br /&gt;&lt;br /&gt;“Parents obviously have the primary responsibility to keep their children safe,” said Storch.  “But government also has a key role as a partner in protecting our children.  Many parents rely on government to ensure that child care facilities adhere to the appropriate health and safety standards so it is critical that we have strong laws and regulations,” said Storch.&lt;br /&gt; &lt;br /&gt;Storch’s bill includes four specific components:  1) eliminates a Missouri-specific provision that exempts children related to a child care provider from licensure requirements (none of the eight states that surround Missouri have such an exemption); 2) requires unlicensed facilities to disclose their unlicensed status; 3) allows regulators to take immediate action to shut down an illegal facility; 4) enhances penalties for non-compliant facilities.&lt;br /&gt;&lt;br /&gt;“It should not require the death of a child to force the state to take action,” said Storch.  “However, sometimes a tragedy like this opens the eyes of elected officials and regulators. In the past, loopholes in Missouri law have left children unprotected.  While the vast majority of child care facilities adhere to the appropriate standards, we have an obligation to ensure that ‘bad actors’ are shut down or brought into compliance immediately so that children are not at risk.  Strong laws and meaningful penalties will protect our children. LOUIS POST-DISPATCH&lt;br /&gt;09/17/2008&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.stltoday.com/stltoday/news/stories.nsf/stlouiscitycounty/story/0418A07BD495BDA1862574C70011F241?OpenDocument"&gt;See the article&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;After 17 years of using the same rules, Missouri is considering revising the safety and licensing standards for the state's 2,200 child care centers and group homes.&lt;br /&gt;&lt;br /&gt;A work group of about 40 met for the first time Tuesday in Columbia to consider reshaping the regulations — enacted in 1991 — that deal with everything from class enrollment size to professional development, hygiene and safety in the centers. If successful, the state expects to put the new rules on the books a year from now. It will then address rules for in-home day cares and other settings.&lt;br /&gt;&lt;br /&gt;This is the second time in three years the state has attempted to revise the rules that some consider outdated and lax.&lt;br /&gt;&lt;br /&gt;All of Missouri's eight neighboring states, for example, require their child care workers to take a basic first aid courses, and seven require CPR training for at least some workers. Missouri's workers, though required to have 12 hours of unspecified training a year, may begin their employment without basic health or safety instruction, and have no CPR or first aid training. &lt;br /&gt;&lt;br /&gt;"We require this training of people who do our nails and our hair and the basic grooming of our dogs, but not to the care of our children," said Carol Scott, director of the Missouri Child Care Resource and Referral Network, one of the members of the work group, which includes child care providers, policymakers and regulators. &lt;br /&gt;&lt;br /&gt;Basic safety training is a critical issue for Steve and Shelley Blecha, whose baby Nathan died of suffocation last year when a caregiver put him down for a nap on his abdomen — a practice condemned by health professionals because of the risk of sudden infant death syndrome.&lt;br /&gt;&lt;br /&gt;A required course in infant safety would have likely saved his son's life, Steve Blecha said.&lt;br /&gt;&lt;br /&gt;"How much more simple can it be?" he asked. "If he had been placed face up, he wouldn't have died."&lt;br /&gt;&lt;br /&gt;In 2005, the Missouri Department of the Health and Senior Services, which oversees child care regulation in the state, attempted unsuccessfully to internally revise the rules for every type of provider at once. It failed to gain support from providers, who argued the changes would prove a financial hardship.&lt;br /&gt;&lt;br /&gt;This time, the state is taking a different approach. In June it held five public hearings around the state to collect opinions from providers, parents, regulators, safety and education experts. Hired consultants with the National Association for Regulatory Administration then culled the opinions into a report that is now the backbone of the work group sessions, said Corinne Patton, one of the three consultants.&lt;br /&gt;&lt;br /&gt;The proposals considered Tuesday included ways to strengthen employee background checks and capping the number of 4-year-olds allowed in a classroom at 20, and 5-year-olds at 32. There is currently no limit to the number of preschool-age children in a classroom at one time. &lt;br /&gt;&lt;br /&gt;The group Tuesday also considered health and safety training of child care workers, including mandatory CPR and first aid certification, and a basic orientation covering state regulations.&lt;br /&gt;&lt;br /&gt;Work group participants said Tuesday that they were making steady progress. Ann Bingham, director of Childgarden Child Development Center in St. Louis, said the state made a big effort to include providers from around the state in the process.&lt;br /&gt;&lt;br /&gt;"We're really part of a group that's making the rules work for everyone from a management standpoint," she said.&lt;br /&gt;&lt;br /&gt;Tuesday was the first of five work group sessions scheduled through December.&lt;br /&gt;&lt;br /&gt;Scott said her organization plans to push for a review of the state's current policy allowing church- and school-based centers to remain license-exempt. Although these facilities follow fire codes, they don't have to follow licensing rules and aren't subject to inspections by regulators.&lt;br /&gt;&lt;br /&gt;"There's a lot of energy in the state from a variety of stakeholders to have more school child care and the faith-based programs regulated. The question is, how high is the energy to keep things the way they are?" Scott said.&lt;br /&gt;&lt;br /&gt;Although advocates of quality early childhood education said they applaud the drive to revise rules, some, such as Stephen Zwolak, director of the University City Children's Center, warned that Missouri is woefully behind the curve regarding training and early childhood education in its centers.&lt;br /&gt;&lt;br /&gt;During its last legislative session, lawmakers did not advance a quality rating system proposal that would have ranked providers, rewarding those with strong curricula, educated teachers and learning-centered facilities.&lt;br /&gt;&lt;br /&gt;Zwolak said the state needs to raise the bar, focusing also on teacher education. At his child care center, providers — called faculty — are given weekly professional development from early childhood experts on topics such as early literacy, child development and classroom practice. Yet, he said, the state is still struggling to get basic first aid approved.&lt;br /&gt;&lt;br /&gt;"Right now, the state's developed standards as exactly that — the bare minimum," Zwolak said. It takes alot of bravery to put yourself out there and tell your story.  One thing bothers me though...The last lady who called in, "Donna", thinks she's perfect and she would never take her kid to a daycare with 10 children to 2 adults.  Well, I'm not sure about Donna's state of mind because first she thought they said there were TWO HUNDRED kids at that house in Arnold, but, whatever.  I tried to call and comment, but it was too late.  I hate that she was the last caller.&lt;br /&gt;&lt;br /&gt;But, what I would like to ask "Donna" is if she would take her kid to a daycare with 6 kids to 2 adults.  I'd imagine she'd say yes.  I'd also like to know what she thinks about the fact that Missouri doesn't count kids who are related to the daycare provider, and that even though, physically, there were 10 kids there who all needed to be taken care of, Missouri only counts 6.  Because those 4 who are related to the daycare owner magically don't need any care or ever get hurt or need adult supervision.&lt;br /&gt;&lt;br /&gt;So, "Perfect Donna", what do you think about that?  Don't you think there's something wrong there? He suffocated after being put down for a nap on his stomach instead of his back.&lt;br /&gt;&lt;br /&gt;His death was officially declared accidental, but Nathan's parents, Steve and Shelley Blecha, of Imperial, believe the tragedy was preventable and want to save other families from experiencing similar grief.Steve said that when he is out in public and sees a family with a baby, he has to fight the urge to rush up to the parents and tell them to be careful.&lt;br /&gt;&lt;br /&gt;The Blechas do not believe the owner of the day care intended for any harm to come to their son and believe she is remorseful over Nathan's death.&lt;br /&gt;&lt;br /&gt;"We're certainly not doing this to do a witch hunt," Steve said.&lt;br /&gt;&lt;br /&gt;Instead, they want to raise awareness about the dangers of unlicensed day cares and the importance of laying babies to sleep on their backs.&lt;br /&gt;&lt;br /&gt;June 26, 2007&lt;br /&gt;&lt;br /&gt;Just like any other Tuesday morning, the Blechas dropped off Nathan and his 3-year-old brother, Clayton, at the day care in Arnold, expecting to see both of their children later that evening. The Blechas said the day care owner's sister was left in charge of 10 children that day.&lt;br /&gt;&lt;br /&gt;Shelley said the sister explained later that when she put Nathan down for a nap in a separate room, another baby was already soundly sleeping. Not wanting to disturb the first baby's rest, the sister did not turn on the light in the room, and placed Nathan on his stomach to sleep in a playpen.&lt;br /&gt;&lt;br /&gt;Because the room was dark, the sister did not realize the plastic padding on top of the playpen was not only loose but bunched close to Nathan's face.&lt;br /&gt;&lt;br /&gt;"He wasn't a long nap taker," Shelley said.&lt;br /&gt;&lt;br /&gt;Realizing Nathan was sleeping longer than usual, the sister went into the room to check on Nathan only to discover he wasn't breathing.&lt;br /&gt;&lt;br /&gt;He was pronounced dead at a local hospital.&lt;br /&gt;&lt;br /&gt;"I think the only reason the paramedics worked on him was as a courtesy to us," Steve said, convinced that by the time his son was discovered, he was already far past the point of recovery.&lt;br /&gt;&lt;br /&gt;Shelley was quick to note that Nathan's death was not declared a result of Sudden Infant Death Syndrome (SIDS), though the way he died is similar to the way some SIDS deaths occur. The official autopsy report listed the primary cause of death as re-breath, or suffocation.&lt;br /&gt;&lt;br /&gt;The owner of the day care could not be reached for comment.&lt;br /&gt;&lt;br /&gt;Learning to cope&lt;br /&gt;&lt;br /&gt;Though the baby was only 3 months old, Nathan had already developed a distinct personality completely different from his brother, his parents said.&lt;br /&gt;&lt;br /&gt;While Clayton loved being the center of attention and was quite a handful as a baby, Nathan was much more easy going, for the most part only crying when he could not see everything that was going on.&lt;br /&gt;&lt;br /&gt;That distinct personality also left a distinct hole in the family's life.&lt;br /&gt;&lt;br /&gt;The Blechas said that as a toddler, Clayton was a little jealous of his brother at first, but in the last several weeks of Nathan's life, Clayton had warmed up to the role of big brother. The parents even caught the boy singing to the baby on occasion.&lt;br /&gt;&lt;br /&gt;A few days after Nathan died, Clayton asked Steve to fix "my Nathan." The Blechas tried to explain to their son that his brother was with Jesus and that if he looked to the sky he could think of Nathan in heaven.&lt;br /&gt;&lt;br /&gt;"He says, 'I'm going to get a trampoline and jump high enough to bring my Nathan down,'" Steve said. "He still goes into his brother's room and says, 'Nathan has a pretty room, Daddy.'"&lt;br /&gt;&lt;br /&gt;Although Nathan's death was not a SIDS death, Steve and Shelley are grateful for the help they have received from the SIDS foundation, especially in handling young Clayton's reactions to the tragedy since he was at the day care when Nathan died.&lt;br /&gt;&lt;br /&gt;"I'm hopeful that whatever it was that the oldest witnessed, he forgets," Steve said.&lt;br /&gt;&lt;br /&gt;Steve stared longingly at one of his favorite pictures of Nathan.&lt;br /&gt;&lt;br /&gt;"He was such a good baby," he said.&lt;br /&gt;&lt;br /&gt;Nowhere to turn&lt;br /&gt;&lt;br /&gt;The Blechas filed a claim against the day-care owner's insurance company, but to no avail. They said her insurance policy was written with the correct wording to exempt the company from any responsibility because the homeowner did not claim her home business with the company.&lt;br /&gt;&lt;br /&gt;"It just seems like every step of the way we've been punched in the gut," Steve said.&lt;br /&gt;&lt;br /&gt;The Blechas know that no amount of money will remove their months of grief and continued healing, but they had hoped to ease part of the financial burden of the ambulance ride, hospital bills, funeral, burial and loss of wages.&lt;br /&gt;&lt;br /&gt;"It's not the money," Shelley said. "We just feel like something needs to be done."&lt;br /&gt;&lt;br /&gt;Steve agreed.&lt;br /&gt;&lt;br /&gt;"We just don't feel like anything has been done to justify what has happened," he added.&lt;br /&gt;&lt;br /&gt;Missouri law&lt;br /&gt;&lt;br /&gt;In the months following Nathan's death, his family expected that the county or the state would somehow take care of the situation. They soon learned the reality that no charges would be brought against the day care owner.&lt;br /&gt;&lt;br /&gt;While Missouri Revised Statues declare the operation of a child care facility without a license to be unlawful, state law restricts the penalty to a fine, similar to a traffic ticket.&lt;br /&gt;&lt;br /&gt;"So it will only cost you $200 to kill someone's kid," Steve said.&lt;br /&gt;&lt;br /&gt;However, Missouri legislators are ready to take the first steps toward change. State Rep. Tim Meadows, D-Arnold, just signed on as a co-sponsor to a bill last week that will tighten some of the standards required for the licensing of child care facilities.&lt;br /&gt;&lt;br /&gt;"We need to do this," Meadows said. "This is way overdue."&lt;br /&gt;&lt;br /&gt;House Bill 2353, was originally filed by state Rep. Regina Walsh, D-Bellefontaine Neighbors, and allows for a day care license to be revoked if the center fails to meet the standards of its municipality. If the facility meets state requirements but fails to meet stricter conditions required from a local municipality, the city can call Jefferson City and request an investigation.&lt;br /&gt;&lt;br /&gt;"This is not the cure-all, but it is a step forward," Walsh said.&lt;br /&gt;&lt;br /&gt;The bill has already had one hearing.&lt;br /&gt;&lt;br /&gt;"My heart goes out to that family," Meadows said after learning about the Blechas' loss.&lt;br /&gt;&lt;br /&gt;He said he would be in favor of further legislation that forces more responsibility on those who own child care facilities.&lt;br /&gt;&lt;br /&gt;How to choose a child care provider&lt;br /&gt;&lt;br /&gt;When Nathan's older brother, Clayton, was born, Steve and Shelley had no idea how to find an appropriate day care facility. Despite all of the preparedness parenting classes offered at hospitals from Lamaze and breast feeding to tips to calm a fussy baby, the Blechas had no idea how to find the right child care provider.&lt;br /&gt;&lt;br /&gt;"No one teaches you about day cares or how to shop for one," Shelley said.&lt;br /&gt;&lt;br /&gt;Deciding they preferred the personal, homey environment of an in-home day care-known by the state as a family child care home-the Blechas interviewed multiple candidates.&lt;br /&gt;&lt;br /&gt;Steve and Shelley finally decided on a woman who had been suggested by their church. They were impressed by her structured curriculum.&lt;br /&gt;&lt;br /&gt;"She seemed like she knew what she was doing," Steve said.&lt;br /&gt;&lt;br /&gt;Shelley admitted that she knew the day-care provider was not licensed by the state, but the young mother did not realize then that providing child care, even in one's own home, without a license is illegal. She even recommended the day-care services to other families.&lt;br /&gt;&lt;br /&gt;"It never dawned on me that I should be concerned about that," Shelley said.&lt;br /&gt;&lt;br /&gt;Christine Soong, owner of A Child's Place in Barnhart, started her business as an unlicensed day care in her home but quickly took on the classes required for licensing, including the training that emphasizes the importance of baby sleeping positions.&lt;br /&gt;&lt;br /&gt;Soong said day-care owners are required to go through 12 hours of training every year to maintain their licenses. The state performs inspections to make sure all of the center's standards meet state requirements.&lt;br /&gt;&lt;br /&gt;She also said that the records of child care facilities and day care centers are open to the public.&lt;br /&gt;&lt;br /&gt;The Missouri Department of Health and Senior Services Web site provides tips to choosing an appropriate and legal day care.&lt;br /&gt;&lt;br /&gt;In hindsight, the Blechas know they could have asked more questions and raised concerns.&lt;br /&gt;&lt;br /&gt;"If you have to say, 'Wow, it's amazing she can take care of so many kids. I could never do that,' it's a sign," Shelley warned.&lt;br /&gt;&lt;br /&gt;Sympathetic to the Blechas grief, Soong complimented their efforts toward change.&lt;br /&gt;&lt;br /&gt;"I think it's fantastic that they're trying to make more of an awareness," she said.&lt;br /&gt;&lt;br /&gt;Today&lt;br /&gt;&lt;br /&gt;The Blechas have been active with SIDS, networking with other families who have suffered the loss of a baby. Because the organization was the only helpful resource for the family after Nathan died, Shelley has worked hard with SIDS Resources to plan the first Strides for SIDS event, a 5k run fund-raiser for the organization. The event is planned for May 31 at Forest Park.&lt;br /&gt;&lt;br /&gt;The family has other reasons to be excited. But the audit said such low penalties have had little effect on some operators who mightmake $100 a week per child.&lt;br /&gt;&lt;br /&gt;It also noted that surrounding states charge much higher fines, including Nebraska, which charges operators $5 per day for each child over capacity, and Kansas, with a fine of $500 per violation per day.&lt;br /&gt;&lt;br /&gt;In a written response, the department said it was collecting information on substantiated cases against illegal child-care providers and would use that data to determine whether increased penalties are warranted.&lt;br /&gt;&lt;br /&gt;The audit also criticized state laws that allow children related to the operators of home-based day-care centers to be exempt from many licensing regulations.&lt;br /&gt;&lt;br /&gt;For example, they aren’t counted against the 10-child limit for family day-care home centers or the 20-child limit for group homes, potentially allowing child-care centers to become overcrowded.&lt;br /&gt;&lt;br /&gt;Also, related children don’t show up in child discipline or illness records, exposing other children to increased risk of abuse or disease.&lt;br /&gt;&lt;br /&gt;Department officials said they tried to count related children toward licensing requirements as part of a 2004 wholesale change of child-care regulations but public criticism led them to shelve the entire measure. They said they will introduce new licensing rules this year focused solely on the related-children issue.&lt;br /&gt;&lt;br /&gt;Auditors also found problems with how long it takes the department to complete investigations into complaints and refer them for legal action. However, babies do tend to cry more when placed on their backs. In fact, for many "hard to soothe" infants, placing them on their stomachs does seem to calm them and help them fall to sleep. Also, babies wake less when on their stomachs and it takes more stimulation to wake them than when they are on their backs. Another thing we know is that tummy-sleeping infants retain more heat than when on their backs. &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;But should parents give in and place their little ones on their tummies? They should certainly not! &lt;/strong&gt;Infants are more likely to have apnea (pauses in breathing) when on their stomachs. They are also more likely to re-breathe the air they have just exhaled, which can raise their levels of carbon dioxide. The increased retention of body heat can also be dangerous for some infants. &lt;strong&gt;But more convincing than any other fact is that belly-sleep has up to 12.9 times the risk of death as back-sleep*.&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;* Changing concepts of sudden infant death syndrome: implications for infant sleeping environment and sleep position. But they agree SIDS is not: &lt;br /&gt;&lt;br /&gt;-- The result of homicide or accidental suffocation or strangulation. &lt;br /&gt;&lt;br /&gt;-- The result of neglected illness, accidents or abuse, or the Munchausen by Proxy syndrome, in which parents harm their children so the parents get attention from doctors. &lt;br /&gt;&lt;br /&gt;-- Preventable. There are things parents can do to reduce the RISK of their baby dying from SIDS, like place him or her in a back sleeping position, breastfeed and not smoke. But some babies still die from the syndrome when all precautions have been taken. &lt;br /&gt;&lt;br /&gt;-- Treatable. While there are occasional reports of "near-SIDS" events, these are in fact some other type of life-threatening event generally affecting low-birth-weight or premature infants. SIDS babies cannot be revived. &lt;br /&gt;&lt;br /&gt;-- Apnea (cessation of breathing). People of all ages do stop breathing for various medical reasons, but in SIDS, not breathing is a result, not the cause of death. Infants with apnea can be resuscitated; babies who die from SIDS cannot be. &lt;br /&gt;&lt;br /&gt;-- The result of infant botulism, which often strikes babies around the same age. Botulism can easily be found by medical tests after death. &lt;br /&gt;&lt;br /&gt;-- Caused by immunization. Although SIDS may coincide with some baby shots, there is no proven link and babies who have not been immunized have also died from the syndrome. &lt;br /&gt;&lt;br /&gt;-- Caused by colds or stomach viruses. While many parents report their infant had recently had a bout with such illnesses, researchers say this timing is also coincidental and not any direct cause of SIDS. The syndrome is not contagious. &lt;br /&gt;&lt;br /&gt;-- Hereditary. Repeat cases of SIDS in a family are very, very rare. Claire McCaskill's audit on child-care providers called for sweeping changes in the way day-care facilities are run.&lt;br /&gt;&lt;br /&gt;Five years later, has anything changed?&lt;br /&gt;&lt;br /&gt;State legislators and day-care advocacy groups say things haven't changed.&lt;br /&gt;&lt;br /&gt;"There has not been any legislation or any rule regulations passed," said Andie Schleicher, executive director of the Child Day Care Association in St. Louis. "There have been changes, but nothing has passed. There are a lot of people working on it."&lt;br /&gt;&lt;br /&gt;Jeanette Mott Oxford, state representative for the 59th District in St. Louis, is one of those people. She's been working to improve income guidelines for subsidized child care for more than three years.&lt;br /&gt;&lt;br /&gt;"Other child-care legislation has been in the works, but it's my understanding that nothing has been done to address the problems the audit pointed out," she said. "Part of the problem is that no House committee is charged with overseeing child-care issues, and I think that's a real shame."&lt;br /&gt;&lt;br /&gt;The audit, conducted when McCaskill was the state auditor, said day-care regulations do not adequately limit the number of children allowed in a day-care facility and penalties are too weak to deter providers from breaking the law.&lt;br /&gt;&lt;br /&gt;Not only is punishment lacking, according to the audit, but there is no standard criteria for penalizing providers when there has been a violation.&lt;br /&gt;&lt;br /&gt;Child care providers are required to be licensed in Missouri if they care for more than four children, according to the audit, but bureau officials suspect there are several thousand unlicensed child care facilities operating in Missouri.&lt;br /&gt;&lt;br /&gt;Another problem is that state law allows a licensed family child-care home to care for 10 unrelated children — and an unlimited number of related children.&lt;br /&gt;&lt;br /&gt;Brewer said the problem with being allowed to have an unlimited number of related children is that there could be way too many kids at the facility and too few adults.&lt;br /&gt;&lt;br /&gt;The death of an infant at an unlicensed day-care facility in Nixa earlier this year brought attention to problems at unlicensed day-care centers.&lt;br /&gt;&lt;br /&gt;Police said the 4-month-old died accidentally. Shelby was between two and 12 times more likely to die of SIDS as a result, LePage's attorney, Gerald S. Sack, said. &lt;br /&gt;&lt;br /&gt;After the verdict in the wrongful death case was read at Rockville Superior Court, a relieved Mary LePage said &lt;strong&gt;the case sends an important message to day care providers, who, she said, have been slower than parents to grasp the significance of sleeping position.&lt;/strong&gt; LePage, who took the stand during four days of testimony, said the trial was emotionally difficult but important for that message. &lt;br /&gt;&lt;br /&gt;"If this information getting out saves the life of one child, then it was worth it," she said. &lt;br /&gt;&lt;br /&gt;LePage, of Coventry, waited 74 days after Shelby's birth to return to her job at a printing company in Norwich. The next day, Shelby's second at the day care center, LePage got a phone call. For her, every new parent's worst fear had come true. &lt;br /&gt;&lt;br /&gt;Police investigated, as did state child-service workers. A pathologist from the state medical examiner's office ruled that Shelby died of SIDS and classified the manner of death as natural, rejecting such options as homicide or accident. &lt;br /&gt;&lt;br /&gt;No action was taken against Horne or her day care program -until LePage filed the wrongful death lawsuit on behalf of her daughter's estate. &lt;br /&gt;&lt;br /&gt;After the verdict, Horne shook her head and stared into an empty corner. She walked from the courtroom red-eyed and stunned. &lt;br /&gt;&lt;br /&gt;"It's not fair," she said as her attorney, Jay Melley, rushed to her side. "It was natural causes. It's not fair." &lt;br /&gt;&lt;br /&gt;Melley had argued that experts have conflicting opinions about the link between sleeping position and the poorly understood syndrome that took Shelby's life. &lt;br /&gt;&lt;br /&gt;"It's a curveball from nature," he told the jury. "It happens without explanation." &lt;br /&gt;&lt;br /&gt;After the verdict, Melley declined comment and would not say whether he would appeal. &lt;br /&gt;&lt;br /&gt;Although similar actions have been brought in other states, William J. Sweeney, past president of the Connecticut Trial Lawyers Association, said he knew of no such cases in this state. &lt;br /&gt;&lt;br /&gt;"I certainly know of people who have thought of bringing one," Sweeney said, "but most people think it's a pretty tough case to win" because of the sudden nature of the syndrome. &lt;br /&gt;&lt;br /&gt;Sweeney said one of the issues that vexes such claims, and one that he believed probably will be raised on appeal, is whether the defendant should have been able to foresee the danger of a syndrome that strikes so suddenly and, often, without warning. &lt;br /&gt;&lt;br /&gt;The verdict came just hours after Dr. Ira Kanfer told the jury that SIDS can occur to a child in any position, even "in the arms of a mother." I wish my child hadn't died. I wish I had him back.&lt;br /&gt;&lt;br /&gt;2. I wish you wouldn't be afraid to speak my child's name. My child lived and was very important to me. I need to hear that he was important to you also.&lt;br /&gt;&lt;br /&gt;3. If I cry and get emotional when you talk about my child I wish you knew that it isn't because you have hurt me. My child's death is the cause of my tears. You have talked about my child, and you have allowed me to share my grief. I thank you for both.&lt;br /&gt;&lt;br /&gt;4. I wish you wouldn't "kill" my child again by removing his pictures, artwork, or other remembrances from your home.&lt;br /&gt;&lt;br /&gt;5. Being a bereaved parent is not contagious, so I wish you wouldn't shy away from me. I need you now more than ever.&lt;br /&gt;&lt;br /&gt;6. I need diversions, so I do want to hear about you; but, I also want you to hear about me. I might be sad and I might cry, but I wish you would let me talk about my child, my favorite topic of the day.&lt;br /&gt;&lt;br /&gt;7. I know that you think of and pray for me often. I also know that my child's death pains you, too. I wish you would let me know those things through a phone call, a card or note, or a real big hug.&lt;br /&gt;&lt;br /&gt;8. I wish you wouldn't expect my grief to be over in six months. These first months are traumatic for me, but I wish you could understand that my grief will never be over. I will suffer the death of my child until the day I die.&lt;br /&gt;&lt;br /&gt;9. I am working very hard in my recovery, but I wish you could understand that I will never fully recover. I will always miss my child, and I will always grieve that he is dead.&lt;br /&gt;&lt;br /&gt;10. I wish you wouldn't expect me "not to think about it" or to "be happy." Neither will happen for a very long time, so don't frustrate yourself.&lt;br /&gt;&lt;br /&gt;11. I don't want to have a "pity party," but I do wish you would let me grieve. I must hurt before I can heal.&lt;br /&gt;&lt;br /&gt;12. I wish you understood how my life has shattered. I know it is miserable for you to be around me when I'm feeling miserable. Please be as patient with me as I am with you.&lt;br /&gt;&lt;br /&gt;13. When I say "I'm doing okay," I wish you could understand that I don't "feel" okay and that I struggle daily.&lt;br /&gt;&lt;br /&gt;14. I wish you knew that all of the grief reactions I'm having are very normal. Depression, anger, hopelessness and overwhelming sadness are all to be expected. So please excuse me when I'm quiet and withdrawn or irritable and cranky.&lt;br /&gt;&lt;br /&gt;15. Your advice to "take one day at a time" is excellent advice. However, a day is too much and too fast for me right now. I wish you could understand that I'm doing good to handle an hour at a time.&lt;br /&gt;&lt;br /&gt;16. Please excuse me if I seem rude, certainly not my intent. Sometimes the world around me goes too fast and I need to get off. When I walk away, I wish you would let me find a quiet place to spend time alone.&lt;br /&gt;&lt;br /&gt;17. I wish you understood that grief changes people. When my child died, a big part of me died with him. I am not the same person I was before my child died, and I will never be that person again.&lt;br /&gt;&lt;br /&gt;18. I wish very much that you could understand; understand my loss and my grief, my silence and my tears, my void and my pain. I'm sure she feels terrible. But, feeling really bad after the fact doesn't prevent terrible things from happening. However, feeling really informed and maybe even scared you might get in trouble does prevent terrible things from happening.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;My point is this:&lt;/strong&gt;&lt;br /&gt;If someone who is given the responsibility of caring for an infant knows that putting that infant on his tummy for a nap could result in getting charged with child endangerment, or even attempted murder, she wouldn't do it. Because it &lt;strong&gt;IS&lt;/strong&gt; that big of a deal.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;So my goal is this:&lt;/strong&gt;&lt;br /&gt;Strengthen the law regarding infant sleep placement, and establish harsher penalties in order to deter people from doing it. By strengthening the law and having harsher penalties we will be informing people. Because in turn, it will get news and other media coverage. This needs to become information that the common person knows. A drunk driver who crashes his car into someone and kills them can't just tell the judge he didn't know he wasn't supposed to do that.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Consider this:&lt;/strong&gt;&lt;br /&gt;Drunk driving wasn't always against the law&lt;br /&gt;We didn't always have to wear seat belts&lt;br /&gt;Children weren't always required to be in a car seat&lt;br /&gt;Doctors used to tell pregnant mothers to smoke and have a glass of wine to relax&lt;br /&gt;&lt;br /&gt;We can make a difference! Please write your two Senators and your Representative urging them to do the following:&lt;br /&gt;&lt;br /&gt;· Encourage &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_0"&gt;NICHD&lt;/span&gt; to continue to fund the SIDS research plan. This plan looks at the continuum of sudden death in early life that encompasses the last weeks of gestation (stillbirths) and the first year of life (SIDS).&lt;br /&gt;&lt;br /&gt;· Establish a House committee with overseeing child-care issues.&lt;br /&gt;&lt;br /&gt;· Establish regulations to adequately limit the number of children allowed in a day-care facility.&lt;br /&gt;&lt;br /&gt;· Establish standard criteria for penalizing providers when there has been a violation.&lt;br /&gt;&lt;br /&gt;· Strengthen penalties that are too weak to deter providers from breaking the law.&lt;br /&gt;&lt;br /&gt;· Provide funding for demonstration projects for the CDC Sudden Infant Death Scene Protocol in rural, urban, and suburban settings to provide a nation-wide protocol for dealing with infant death scenes.&lt;br /&gt;&lt;br /&gt;Furthermore, telephone calls and personal visits to your local or Washington, DC Congressional offices are also important and have tremendous impact on legislators. Legislators are always interested in responding to constituent concerns. The statement recommended that all healthy infants be placed on their backs to sleep in order to reduce the risks of SIDS. Shortly thereafter, the NICHD joined with the AAP, the SIDS Alliance (now First Candle/ SIDS Alliance), the Association of SIDS and Infant Mortality Programs, and the Maternal and Child Health Bureau of HRSA to launch the Back to Sleep campaign to help inform all parents and infant care givers about the importance of back sleeping. This blog was created in an effort to let me spend my energy creating something good from something that was tragic.  In June, my 3 months and 2 day old nephew died while at daycare.  He was put down for a nap on his tummy in a pack and play and he suffocated.  In effort to respect the privacy of his parents, I will not give my nephew's name, or the names of the people who were in charge of the daycare he was at.  (Unless they want me to, and in that case I'll scream it at the top of my lungs, because he matters, and the daycare providers need to be made an example out of - not being vengeful, but we need to change the way things are handled, NOW.)&lt;br /&gt;&lt;br /&gt;The means by which my nephew died were completely avoidable.  No one should ever put a baby down for a nap on their tummy.  No one person should ever be left incharge of the care of 10 children.
